Nintendo just pressured a takedown for all Nintendo music on BrawlBRSTMs3 X's channel!
They might take down the channel altogether!

At least Nintendo doesn't give 2 shits about the Mother franchise so i can still be into that without takedown risk

Plus we also have the original GilvaSunner and Gbelair3

As far as my knowledge goes, Fair Use implies that the portions of original work used are altered enough to warrant a change of purpose and meaning.

A channel that just posts copyrighted music with next to no changes but making the music play for longer, probably wouldn't classify as Fair Use, as the purpose and meaning of the music doesn't change.

If Nintendo shuts down something, it usually means they are making something similar

They shut down AM2R not too long before the Metroid 2 3DS remake

They shut down Super Mario Bros. X (which has since resurfaced though) around the time they were planning Super Mario Maker

They cracked down on ROM sites around the time they were going to launch the Nintendo Switch Online NES lineup

The takedown of Nintendo's music on BrawlBRSTMs3 X's channel means Nintendo might be making some sort of service to listen to music from various Nintendo games

Basically it's almost like they are stealing ideas from fans







And i said earlier that Nintendo doesn't give a shit about the Earthbound/Mother series, i have some evidence:

Mother 3 hasn't been officially released in the US or EU, 1 and 2 have

The Mother 4 fangame was rebranded in fear that Nintendo would take it down, not because of an actual takedown notice

Only major Mother/Earthbound series characters and enemies have shown up in Smash Bros. games

Nintendo didn't crack down on any popular hacks like the Mother 3 fan translation or Earthbound Halloween Hack

The Earthbound/Mother fanbase basically started because of ROM trading, and Nintendo never did anything about it

Hirokazu Tanaka, the composer for Mother 1 and 2, liked a song that Nelward (The composer for the fangame Mother 4) made, therefore confirming that one person involved in development of the game series probably likes fanmade content

So basically if you're into a Nintendo franchise that Nintendo doesn't care about and only appears in Smash Bros. games now, like F-Zero, Earthbound/Mother, or franchises like that, you're mostly safe from getting your fanmade content taken down, it's the big money makers like Mario, Zelda, and Splatoon that you'll get takedowns on

Why can't we just have a friendly endorsing company

Look at when Capcom shut down the fan RE2 remake
They explained why, asked to shut down, then literally gave the fans a trip to the studios and
put their names in the credits in the official RE2 remake. That is super overgenerous.

No company needs to be that kind but it is encouraged that the takedown should not be a forced DMCA and giant law problem, but a request possibly with a make up gift. Nintendo should at least do that.
